There are many benefits when we have a lawyer as a friend. In any case, what one thinks about lawyers, but when we need one, they are our saviour. A lawyer always understands his client's situations and guide educate and guide them to the best possible way. For helping one, a lawyer needs the client they can work with. When a lawyer works for his client, both of them enters into an ethical concern. There are areas which are known as the lawyer-client relationship, where the lawyers play the role of a counsellor, advocate, performing public services, getting information about the law, etc.

When we talk about the lawyer-client relationship, we should know that a lawyer must always follow some sense of morality while working with their clients. A lawyer must have a sound judgment which is fair and sensible, in order to represent his client in his legal issues. Some lawyers may also ask for extra time for studying to become competent in that area of law. One of the most professional duties of the lawyer is to keep all the information regarding the representation of the client confidential.

There are two ways in which a lawyer can help his client –

  1. Lawyer as a counsellor, and
  2. Lawyer as an advocate

Lawyer as a counsellor – a lawyer, has many roles in the legal field, and one among the entire role is the role of a counsellor. As a counsellor, a lawyer gives candid information and advice that refers to the legal issue. The advice includes moral, social and political issues relevant to the client's situation.

Lawyer as an advocate – the essential role of a lawyer is to be an advocate. However, as a lawyer should do, he must always follow the moral rules and should not go against the ethical boundaries to gain legal victory. A lawyer cannot make false statements and defend his client. Also, a lawyer must disclose the facts and legal precedent necessary to avoid any miss happening in the court. A lawyer also has the responsibility of expediting litigation.

A lawyer-client relationship is built on trust, and it is sacred in the eye of law. A client should expect that their attorney will keep their communication confidential and in extreme situations, a court must protect the revelation of the client to an attorney as well.

Accordingly, while dealing with an attorney for a legal issue, a client should always be loyal and honest and always keep his lawyer updated if any changes take place in circumstances. In return to that, a client should expect that the attorney must do the following –

  • Make sure that the lawyer has no conflict of interest.
  • Make sure that a lawyer behaves morally according to the applicable Rules of Professional Conduct.
  • A lawyer must not abuse the justice system.
  • A lawyer should advise the client of the payment structure and fee schedule.
  • A lawyer must listen to the client's version of events and ask questions when appropriate to elicit pertinent information.
  • A lawyer must keep the client matters confidential.
  • A lawyer must always advise the client of his or her legal rights and responsibilities.
  • A lawyer must perform any necessary research to answer questions and support the client's cause.
  • A lawyer must represent the client's interests competently, professionally and diligently.
  • A lawyer must propose a legal course of action to resolve the client's problem based on an independent professional analysis of applicable facts and law.
  • A lawyer must assess the client's chances of winning a case honestly.

If we are not a lawyer, we do not have the same actions in some cases. Even experienced lawyers usually do not represent themselves in court. Likewise, failing to hire a lawyer before starting a business, reviewing a contract, or embarking on other endeavours with potential legal ramifications can result in otherwise avoidable pitfalls.
