SECTION-56: PERSON ARRESTED TO BE TAKEN BEFORE THE MAGISTRATE OR OFFICER IN CHARGE OF POLICE STATION

Section 56 of the Code of Criminal Procedure, 1973, provides that the police officer making an arrest without warrant shall take or send the arrested person before a Magistrate having jurisdiction of the case or before the officer in charge of the police station. The arrested person should be sent to the Magistrate without unnecessary delay and subject to the provisions herein contained as a jail.
