SECTION- 30: SENTENCES OF IMPRISONMENT IN DEFAULT OF FINE


Section 30 of the Code of Criminal Procedure, 1973, authorizes the Magistrate to award a term of imprisonment to a person who defaults in payment of the fine as authorized by the law. It also states that the term should not be in excess to the Magistrate’s powers as specified under the code. If such a case arises where the imprisonment has already been awarded by the Magistrate as a part of the sentence, then the period of imprisonment for the default of fine shall not exceed to one fourth of the period of the imprisonment.
