HON’BLE JUSTICE MAHESH CHANDRA TRIPATHI

Hon'ble Justice Mahesh Chandra Tripathi was born on 21st June 1966. He graduated in law from Lucknow University in 1990, enrolled himself as an advocate on 11th January 1992, practiced mainly on Civil Side, and was the Additional Chief Standing Counsel, state of Uttar Pradesh from October 2007. Justice Mahesh Chandra Tripathi was also an adviser for the Kanpur Development Authority, Kanpur Nagar Nigam, UP Food and Essential Commodities Corporation, Agra Development Authority, Moradabad Development Authority, and Kumaun University. Later on, He elevated as Additional Judge on 27th September 2013. He took oath as a Permanent Judge on 10th April 2015. Justice Mahesh Chandra Tripathi has appointed as an Additional Judge of Allahabad High Court along with Justice Suneet Kumar. Currently, he is in Allahabad as an Administrative Judge for the District: Mathura, Mainpuri, and Hathras.

The Allahabad high court stated the dismissal of a woman police constable from service for marrying her colleague, a married constable, on the ground that the removal is too severe a punishment. Following which, the woman police constable, Aneeta Yadav, filed a writ petition. On which, Justice Mahesh Chandra Tripathi noted that there is no provision under the Uttar Pradesh Government Servant Conduct Rule, 1956, for granting a severe punishment like expulsion from duty for solemnizing marriage with a married man or woman. The court also said that these are the cases where if charges are proved, a minor punishment can be awarded. Delivering the Judgment recently, the court quashed the order of dismissal dated 20th June 2016 and other consequential orders and ordered the senior officers of the Uttar Pradesh Police department to reinstate the petitioner straight away with all the significant compensations and benefits.

The Allahabad High Court on 31st May 2017 directed the CBI to look into all the cases of issuance of fake certificates by the Gwalior based Board of Secondary Education, Madhya Bharat. A Division Bench comprising of Justice V K Shukla and Justice Mahesh Chandra Tripathi passed the order on the bench of petitions about the certificate issued by the Board in favor of candidates hailing from Bihar. The Division Bench noted that while the Board registered under the Societies Registration Act, it was ''absolutely lacking'' the authority to conduct examination and issue certificates.  The court also said "We find that the Board is not at all in existence and issuance of certificates is a planned activity, by luring such candidates who on their own will not at all be in a condition to clear examinations conducted by a duly acknowledged board,". One of the petitioners submitted a fake certificate, which was not issued by the Board but "received from a gang". Upon which, FIRs have been lodged at Haryana, Delhi, and Gwalior about such fake certificates. The court said it'll be much more powerful and in the interest of cleansing the education system that the Director of Central Bureau of Investigation should take up the matter to which the state of Uttar Pradesh has no objection.

The Allahabad High Court on 9th March 2017 set aside the order passed by the state government where it had waived the interest of around ₹ 2,000 crore which was payable to the cane-growers by sugar cane factories for delayed payment for 2012-13, 2013-14, and 2014-15. The division bench of Justice Vimlesh Kumar Shukla and Justice Mahesh Chandra Tripathi delivered the judgment. The interest amount for 2012-13 and 2013-14 of over Rs 1,300 crore was waived by the state government in May 2015 by considering the request of mill owners that they were in no condition to pay interest for delay in payment as they had incurred losses due to reduction in sugar prices. The state cabinet had further waived over Rs 700 crore that was to be paid as interest for the season 2014-15.

In another case, the petition filed by Google LLC sought to set aside the order of the trial court passed on 14th September by which it had rejected the stay application filed under Section 151 of the Code of Civil Procedure, 1908 against the questioned ex parte decree. On which, the Allahabad High Court has issued a notice in a plea filed by Google LLC challenging a permanent injunction passed by a trial court amounting to blocking of videos of news organizations and de-indexing of news articles. Noting that the matter requires consideration by the Bench. The Bench of Justice Mahesh Chandra Tripathi directed the parties to maintain the status quo.
