Stare Decisis is a Latin word which means “to stand by things decided” i.e., the courts refer to the past and similar issues in order to make judgements. This doctrine basically dictates the courts to look at the similar judgments under similar circumstances that have been passed. Any prior ruling or judgment in any case is called the precedent.
This helps the courts to maintain standardized judgements. It helps serve justice in a uniform manner. If the precedent is given by the same court or a higher court, such as the Supreme Court, the lower court is bound to follow it. The law declared by the Supreme Court is binding on all the courts. Doctrine of Stare Decisis is followed in England. If it is observed that the past ruling does not have a sound judicial ground then the same can be overruled.
For example: The High Courts, District Courts and the other Small Courts in India will follow the precedent that is laid down by the Supreme Court of India.
