Binding precedent are those judgments, decisions or judicial precedents which all the lower courts have to follow. These are decisions of higher courts (Higher in hierarchy of courts) which are binding in nature and all the lower courts are obligatory to follow the rules or decisions made by the higher courts. Binding precedents are also popularly known as Judicial Precedents. e.g. The Supreme Court of India has made a certain rule it’ll be mandatory to follow for all the high courts and respective district courts. This legal term is mainly used in courts in working of the courts hierarchy system.
