Article 226 of the Constitution.
Respondent was transferred from his duty place to another place so the respondent moved to CAT for interim stay of the order of transfer. The order was granted and after a time of a month it was dismissed when CAT heard OA. The respondent aggrieved from the decision of the CAT went to the HC. The order of transfer was issued by the Government of India. The HC had passed the order in favour of the Respondent.
SC observed that there shall be no interference of the HC in dictating that where he should be posted. The interim order of the HC was set aside and there shall be no order as to costs.
